These Terms of Service (\"Terms\") govern your access to and use of BurnSky's website, software products, and related services (collectively, the \"Services\"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.\n\n---\n\n## 1. Definitions\n\n- **\"BurnSky,\" \"we,\" \"us,\" \"our\"** refers to BurnSky and its operators.\n- **\"User,\" \"you,\" \"your\"** refers to any individual who accesses or uses the Services.\n- **\"Product\"** refers to any software, tool, or digital good offered through BurnSky.\n- **\"License\"** refers to the limited right granted to use a Product.\n- **\"Subscription\"** or **\"time-limited key\"** refers to a License that is valid for a fixed period (for example a day, a week or a month). It is purchased once and does not renew automatically.\n- **\"Account balance\"** refers to store credit held in your BurnSky account, as described in Section 5.4.\n\n---\n\n## 2. Eligibility\n\nYou must be at least **18 years of age** (or the age of majority in your jurisdiction) to use our Services. By creating an account, you represent and warrant that you meet this requirement. We reserve the right to request proof of age and to suspend accounts that violate this requirement.\n\n---\n\n## 3. Account Registration & Security\n\n### 3.1 Account Creation\n\n- You must provide accurate, complete, and current information during registration.\n- Each individual may maintain only **one (1) account**.\n- Accounts are personal and **non-transferable**.\n\n### 3.2 Account Security\n\n- You are solely responsible for maintaining the confidentiality of your login credentials.\n- You must immediately notify us of any unauthorized access to your account.\n- BurnSky is not liable for losses arising from unauthorized use of your account.\n\n### 3.3 Account Suspension & Termination\n\nWe may suspend or permanently terminate your account if you:\n- Violate any provision of these Terms\n- Engage in fraudulent, abusive, or illegal activity\n- Attempt to share, resell, or redistribute Licenses\n- Provide false information during registration\n- Engage in chargebacks without first contacting support\n\n---\n\n## 4. Products & Licensing\n\n### 4.1 License Grant\n\nUpon valid purchase, BurnSky grants you a **limited, non-exclusive, non-transferable, revocable license** to use the Product solely for personal, non-commercial purposes, subject to these Terms.\n\n### 4.2 License Restrictions\n\nYou agree **NOT** to:\n- Share, resell, sublicense, rent, or lease your License to any third party\n- Reverse engineer, decompile, disassemble, or attempt to derive the source code of any Product\n- Modify, adapt, or create derivative works based on any Product\n- Use any Product for commercial purposes without prior written authorization\n- Circumvent or attempt to circumvent any technical protection measures\n- Use any Product in a manner that violates applicable laws or regulations\n\n### 4.3 Hardware Binding\n\n- Each License is bound to **one (1) hardware configuration** (HWID).\n- Hardware resets are subject to limits and may require support verification.\n- Excessive reset requests may result in License revocation.\n\n### 4.4 Product Updates\n\n- Updates are provided during the active Subscription period at no additional charge.\n- We reserve the right to modify Product features, functionality, or system requirements at any time.\n- We do not guarantee backward compatibility with previous versions.\n\n---\n\n## 5. Pricing, Payments & Account Balance\n\n### 5.1 Pricing\n\n- All prices are displayed and charged in **USD** unless otherwise stated.\n- Prices are subject to change. The price shown at checkout is the price you pay for that order.\n- Promotional prices or discounts are temporary and may be withdrawn at any time.\n\n### 5.2 Accepted Payment Methods\n\n- Cryptocurrency: **USDT**, through the payment page shown at checkout\n- Your **account balance** (see 5.4)\n- Other methods, only where they are displayed at checkout\n\n### 5.3 Time-Limited Keys\n\n- Day, week and month keys are one-time purchases for a fixed period and do **not** renew automatically. Nothing is charged after the period ends.\n- For keys activated through our software, the period starts the first time the key is used.\n\n### 5.4 Account Balance\n\n- Your account may hold a balance in **USD**, credited by approved refunds (see our Refund Policy) or by our support team.\n- Balance can be used to pay for any Product on the site. It is store credit, not cash or electronic money: it cannot be withdrawn, exchanged for cryptocurrency or transferred to another account, and it earns no interest.\n- Balance does not expire while your account is active. It is forfeited if you delete your account or if we terminate it under Section 3.3.\n- We may correct any balance that was credited by mistake.\n\n### 5.5 Unpaid Orders\n\n- Orders that are not paid in full within the payment window shown at checkout expire automatically. Pay the exact amount shown.\n- If a payment arrives after the order has expired, contact support with the transaction details.\n\n---\n\n## 6. Intellectual Property\n\n### 6.1 Ownership\n\nAll Products, software, code, documentation, graphics, trademarks, and other materials are the exclusive property of BurnSky or its licensors and are protected by international copyright, trademark, and intellectual property laws.\n\n### 6.2 No Transfer of Rights\n\nNothing in these Terms transfers any intellectual property rights to you. Your License grants only a limited right to use the Product as specified herein.\n\n### 6.3 User Content\n\nIf you submit feedback, suggestions, or other content to BurnSky, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such content into our Services.\n\n---\n\n## 7. Prohibited Conduct\n\nYou agree not to:\n- Use the Services for any unlawful purpose\n- Attempt to gain unauthorized access to our systems or other users' accounts\n- Interfere with or disrupt the Services or servers\n- Upload or transmit viruses, malware, or other harmful code\n- Impersonate any person or entity\n- Collect personal information of other users without their consent\n- Engage in any activity that could damage BurnSky's reputation or operations\n\n---\n\n## 8. Disclaimers & Limitation of Liability\n\n### 8.1 \"As Is\" Disclaimer\n\nTHE SERVICES AND PRODUCTS ARE PROVIDED **\"AS IS\"** AND **\"AS AVAILABLE\"** WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.\n\n### 8.2 No Guarantees\n\nBurnSky does **not** guarantee:\n- Uninterrupted, error-free, or secure operation of any Product\n- Compatibility with all hardware or software configurations\n- Any specific outcome from using the Products\n- Continuous availability of any particular Product or feature\n\n### 8.3 Limitation of Liability\n\nTO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BURNSKY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.\n\n**MAXIMUM AGGREGATE LIABILITY:** BurnSky's total liability shall not exceed the amount you paid for the specific Product or Service giving rise to the claim during the **thirty (30) days** immediately preceding the event.\n\n### 8.4 Risk Acknowledgment\n\nYou acknowledge and accept that the use of game enhancement software carries inherent risks, including but not limited to account actions taken by game publishers. BurnSky is not responsible for any consequences imposed by third-party platforms.\n\n---\n\n## 9. Indemnification\n\nYou agree to indemnify, defend, and hold harmless BurnSky, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:\n- Your use of the Services\n- Your violation of these Terms\n- Your violation of any third-party rights\n- Any content you submit or transmit through the Services\n\n---\n\n## 10. Dispute Resolution\n\n### 10.1 Informal Resolution\n\nBefore initiating any formal proceedings, you agree to first contact us at **support@burnsky.net** and attempt to resolve the dispute informally for at least **thirty (30) days**.\n\n### 10.2 Binding Arbitration\n\nIf informal resolution fails, any dispute shall be resolved through **binding arbitration** in accordance with applicable international commercial arbitration rules, rather than in court. You waive any right to participate in a class action lawsuit or class-wide arbitration.\n\n### 10.3 Exceptions\n\nNothing in this section prevents either party from seeking injunctive or equitable relief in a court of competent jurisdiction for matters related to intellectual property or unauthorized access.\n\n---\n\n## 11. Modifications to Terms\n\nWe reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated \"Last Updated\" date.
